Can you legally be denied for renting an apartment in NC for having a dropped case on your record?

Me, my boyfriend and our couple friend applied for an apartment, I got approved they got denied. They were at a party a while back...the cops came...and the house was apparently broken into. They all got citations, went to court, and there cases got dropped. The apartment denied us because of their dropped charges on their record. Is this legal?
